Dale, they won't give you your job back after major surgery ?

I would definitely discuss this with an attorney. Also, if your work

permits, could you do something via telecommute while recovering ?

pain. But I have a family that I have to take care of and do what I

have to do. But somedays the pain gets so bad I feel like giving up.

If I get a THR now my job already told me they would not let me come

back. And no way I could find another making the kind of money I get

paid and my health, dental, and vision is all free.And I could be

facing three(possibly more) revisions in my lifetime. I think there is

only so much bone they can work with before they tell you that you are

wheelchair bound for the rest of your life because they cannot do

another revsion. Wheelchair bound, and STILL in this agognizing pain

at 55 or 60 does not sound like a life I wanna live. Ed I am only 35!

This is one time that I only wish I were 60 so I could go on and get

this damn hip out of me and get on with what's left of life. And I

still have to worry about the other hip as well. As it's starting to

show some signs of AVN now.

in california it is a state law that you have to get your job back

if you back within 6 months so check the laws in your state union or

no union the are law that govern

that is most unfortunate, I am sorry, it does not seem right people

get hurt all the time, one would think that 10 years of serice would

mean something, I was self employed for 20 years and did not pay

into disability so I would not have been covered, so I took a job at

a company for 12 months and then I had to get the coverage. but I

have never worked in a union before, maybe taking a non union job

for 12 months will give you the option of getting fixed. Just a

thought

I have already checked the laws. And our local UAW union President. If I do not have a piece of paper stating 100% no restrictions then they will not let me come back to work until I do. If I had this paper. All would be fine and I would go back to work in less than 6 months. Every doctor I have asked so far said they would not be willing to sign a paper like this after a THR. Believe me, I checked because I need my job!

It is not right Tammy and I was brought up to believe that unions, especially large unions like the UAW I belong to, were there to protect the rights of it's members. I guess all this time, I believed wrong. They sure do not complain when they take the $39 a month out of my paycheck for dues. Added to all the employees in my plant, and the 3500 in the main GM plant, and all the other plants they seem to run, that's a HUGE chunk of change they make off of us. And for what? Where does that money go? And why are they not protecting people like me, who put in 10 very hard working years, doing things for this company that have saved them lots of money with some of the ideas I have come up with, and they, after discussing it with their over-paid engineers, have implemented my ideas and use them to this day. Saved them lots of production time and trouble. I train people, teach people better, more time saving ways of doing things, and basically just help out whenever I can understanding that in a JIT(Just-In-Time) work environment, that time is money. And I saved them plenty of production time over those 10 years. I also take on responsibility of "team leader" when he is absent, with no added pay. When I am gone, he gets someone to come fill my position so he does not have to do it even though this is part of his job in the job description handbook we have. When we have computer problems, I have been around computers enough I fix them, then I radio our IT man and tell him do not worry, I took care of the problem. When we have minor maintenance issues, I have always been good about diagnosing machine problems, and fixing them, I radio the maintenance crew and tell them do not worry, all fixed now, thanks to me. These are not my jobs, I am simply the repair man on automotive front driver and passenger seats. If one comes down the line with some dirt on it, I take care of it, get it back online and into the system, then record the repair. If one comes down the line in pieces, I take it off the line, fix it, put it together, and get it back on line before it reaches the end and stops the entire production process. If someone tells me they do not know how to fix something, it comes to me, if it's something I have never seen before, I figure out how to fix it, whether I know how or not, I get it fixed, back on line, and everything is ok. In a very limited amount of time to work with. I cannot come in and say "I don't feel like working hard today, I think I'll just screw off today and leave the work up to someone else". I have the only job in the plant where how hard I work is and never will be dictated by me alone, that is up to the prodution line people and what they decide to send me, whether it be a minor repair I can do without taking the seat off line, or something major which requires me to painfully lift a fully assembled 65-70 lb car seat and carry it to my repair station. That hurts my hip like hell when I have to do that. But who else is going to do it. That's my job. And they are even rumoring cutting my position as a cost saving measure and putting me wherever they want. That was supposed to happen last month, but has since been extended to the end of the year thank God. My hip could not take the repetitive, twisting movements of the production line like it is now. It just isn't right Tammy and I agree with you.

Hey Dale,

I sympathize with you to some extent. However it's not fun on the

other side of the auto industry either. I work for a major auto

manufacturer as well. However I'm in Information Technology. Thanks

to being " management " and non-union. I get straight salary every week

whether I put in 62 or 72 hours. Each week I put in an average

between 55 & 65 hours and I'm on call 24 x 7 x 365. I even have to

take my notebook, pager & cellphone on vacation (REQUIRED). I pay

over $200 a month for medical with a $1,500 annual deductible per

person in the family. At least you get overtime and compensation

time. We get to keep getting our paychecks or leave. Plus we do the

work of at least 3-people as compared with other company IT divisions.

Be glad you have the union.

Dale dont get me wrong I am sure you are good at your job and work

very hard, as do I, I am an engineer (and worth every dime they psy

mr) in a high tech company I work hard too. But my point is only

this... if you need an operation for your better health you can not

get fired if the doctors put you on disability while your getting

your joint replaced, they have to keep a job for you you should

check into that, that being said this group is about joint

replacements and if you need one you need one and will support you,

the doc will put youn 100% disability until you are able to work.

and disability will pay you it is a simple concept that has been

around a long time. you have rights and you should research them

you, if you have no intentions of doing that there is not much we

can do to help youwhat we think and what is actual maybe different,

we all have bills and expenses but this group is about the joint

replacements

Hi Dale,

I forgot to mention that it is illegal in the US for a company to FIRE

you for having a required surgery. As part of the UAW, I know that

you have a minimum of 3-months STD at near full Salary and at least

another 2-3 months at 1/2 to 3/4 salary. Check with your HR dept. or

Union Rep. Only if you go out on Long Term Dis. LTD, can they

replace you.

But you can look at it in another way as well. Be glad you have the education and the IT experience. For, if anything ever happened to your job and you had to start over, I don't suspect it would take too long to find another who will hire you based on your experience and the type of work you do. All my life has been low-level factory production work, I try to learn all I can at any job because I know that gives me better opputunities for advancement, at that job only though. Not like a lot of my co-worker's attitudes who are like "that's not my job, I will do my job and my job only, just barely enough to get by, if they want someone to do something else, then they better hire them". You'd be suprised how a lot of my co-workers think this way. But as I said, advancement at my current job ONLY. If forced to start all over in a factory/production plant type of setting. I will be forced to go back to a 50% or more pay-cut a week. And in 10-15 years, depending on the place and even if it's still there by then the way our production jobs are moving overseas due to competition from China's and Mexico's MUCH lower labor wages and lack of the labor laws we have in place here, in those 10-15 years I could, possibly be back to where the point I am now in weekly wages. And that's a big maybe. If I could start life over, at maybe 20, I would have fought hard to find a way to get a degree in something along the lines of what you do for a living. But that's neither here nor there. As I am 35 now and we cannot turn back time. My wife is also in one of those high demand, easy to relocate type of jobs. That I am grateful for and if we have to rely on her wages for a time, I know she can find work just about anywhere(hopefully) as she's in the health care field. Something we all here know there will always be a need for. I would love to get into police/fire dispatching for a small agency around my area. County or city, does not matter to me. Police/fire scanning has been a hobby of mine for the past 15 years and I have two of them going right next to me as I type this. But then again, the degree thing comes into play. If there is a 20 something fresh out of college with a communications degree in his hand, and me at 35 with no experience other than the hobby and knowing most of the "lingo" dispatchers use and the some of the codes they use, but no degree in my hand, who do you think they would pick for a job like that, no matter what size or agency it would be for. I understand I would probally take a pay-cut from what I do now and would fully accept that, if only to get into a job field I would love to do, like that. So thanks for trying to help with the post Alan. But you have the type of job, and the experience to go with it, that puts you in demand and even if you waited two or three months to get another job. I am sure the pay would be right about the same as what you are used to making now.

Tammy as I have already explained many, many times. I will get $430 a week in temp-disability. That's it. But hey, it's better than nothing. After 26 weeks of this I am on my own with $0 income. When the doc thinks I am able to go back to work, they will ask me for a paper, signed by him, stating 100% no restrictions. Whether it be a THR, a resurface, ect. I have already asked many docs and not a one would be willing to do this for me. So I cannot sue my company, they will keep me on an inactive list, but after two years has passed, without this piece of paper that will never come, they can and will legally terminate my employment there. Without anything I can do. I have even been to my UAW union president over this matter. He threw up his hands and said he could do nothing to help me. That was the rules. How mnay times do I have to explain this over and over and over. I am at a point, after yesterday's happenings, I am not even focused on keeping my job anymore. I need it now, for the $430 a week for 26 weeks, I need it now for medical insurance for my family, especially me now. But if I am ever able to find a doctor that will allow me to get a THR, then after I am healed, I will worry about the job situation later, and find another, maybe. I know we've been through all this before and you said there must be something the union can do. But there isn't. A job of 10 years, down the drain, history. At $20 per hour. But it took me 10 years to get to that wage. I do not even expect I can get half that amount after all this is done and over with.

Dale, you are planning afunurel and you have not died. Why don't you let tomorow take care of itself.

You might be pleasantly shocked that your hip replacement makes you feel so much better that you are able to go back to work easily.

Dale,

I.T. is not all its cracked up to be. I've been laid off 4 times in

20 years and each time it took between 3 and 6 months to find a new

position. It isn't easy because there is a glut of IT workers now

days. But it's never too late for you, you can still get a degree at

home. Just look at AIU, American Intercontinental University. You

can get your Bachelor degree on-line right at home. Then you can

leave the factory line far behind and become " in demand " just like

your wife. You are definitely not without brains or you wouldn't be

able to do what you do at work. You can get government grants to help

you with the payments. GO FOR IT. It's how I'm finally doing my

Masters degree.

dale it is very possible that you could be back to work in 26 weeks,

you seem so gloomy it is hard to find postive words of wisdom for

you as you will always find the gloom and doom in it, it is

depressing unnecessarily get your hip fixed work and getting better

and have a positive attidude. my doc said I can go back to work

whenever I want to. my husband is a director in IT and there are

tons of jobs out there. but frankly the issue here is your hip not

your checking account, as someone said we all had to make sactifices

to get healther. If you do not take care of your hip now where will

you be in 1o years. you need to think positive if you want a

positive outcome, do yourself a favor , all of your posts are gloomy

and good people here are trying to make you feel better but I am

beginning to think that is hopeless, and thanks for the attorney

message but I am not interested, my doctor fixed me in the second

surgery so I am getting better.

Tammy, I have been thinking about you since you were in so much pain the other day. Are you doing better? Did you go to the hospital? I hurt in my heart when I read about your pain being that bad.

thanks Terry I am doing better just went to the doc today and have

teh secod set of xray pic I will add in a few minutes what a

difference, still in bed a lot but it is right now and everyday gets

I only wish what you said were true. I have already spoken to my UAW local president in his office privatley. He said everything my union rep I asked about all of this on nightshift said was true. And it's $430 a week for 26 weeks for us. Then after the 6 months is up, $0 for the remainder, until a period of two years has passed. Then, if they do not have in writing from my ortho that I am 100% free of any and all restrictions after a THR, then they can and will legally terminate me. They cannot do so until a period of two years has passed though. And I already asked two of my orthos about this matter. They stated they were only there to preserve my hip's future and do what they could to end the pain, and they were not in the business of preserving jobs. That was between me and my company I work for. And that they would never consider signing a paper like that, mainly just to cover them and there were no guarantees with a THR, and everyone was different. Believe me, I already checked into all of this. And maybe it's different by state I do not know. But this is the way it is here. And also, the foreign companies have ways of "skirting" around our US laws. And getting away with it. I was told by the Teamsters union president at my last job that it was illegal for a company, foreign or US, to threaten to shut down a place if the union made it in. Well, the union made it in, and 6 months later the company moved to China and left me and about another 300 employees without jobs. The ONLY thing we had availiable to us because of this was, they were willing to pay up to $11,000 a year tuition at a local college for any re-training. But the only thing is, you could not have a job during this time period of going to college, only collect the $250 a week unemployment. I do not know what it's like where you live, but one could never make it on $250 a week here unless they had a spouse already making good enough money to make up for the loss. So the only ones that took advantage of the offer were women whos husbands already had good paying jobs. I am sure these women are doing very well for themselves now. I would not know as I never followed up on anyone's future from that place. I moved to this city because there were no other decent paying jobs in that smaller town.

That's what I think as well. That after the replacement I will be able to do anything at my current job that I already do. Only probally better and without the pain. But I cannot change what's in our contract, and again, it states that they must recieve from the doc a 100% no restrictions signed paper. And since this will not happen, it will be up to my workplace to decide on whether to keep me or not. But only if I can come back under the time periods I specified. I know this means they must bend the rules a little just for me. Will they like to do this? Probally given that I am on a specialized job and the supervisor likes me and I am well liked by everone there. And have 10 years of service in with this company. But will they do this, all other things set aside and just going by what it says in our company contract that comes from the head of corporate level? Probally not, as if they did it with just me, then that would set a precedent and they would have to do it with everone else in the future or open themselves up to lawsuits. I wish it were different but it is not. But then only time will tell I guess.

Dale I bet if you told your doc to sign something for work, he would

not even read it and just sign it. There are ways to get around this

stuff. He just thinks he was signing an ok to go back to work. Stop

blaming the doc and get on with life! It is elective surgery, so

elect to get fixed before it is too late.

I doubt any doctor would blindly sign a paper. It's all about

possible litigation. But really what restrictions would there be

that would inhibit most jobs? If a specific job decription would be

given to the doctor than the doctor might consider signing it seeing

that physical limitations would not likely be compromised in this

person's working enviroment.

Dale, this is how I am. I don't mess around wondering about stuff. I am straight forward. If I want to know something, I ask.

I deal with alot of teachers, doctors, dentists etc. with having nine kids. Some are special needs and we have IEP's etc.

I am bold and I ask. You can spend hours in misery wondering about what will happen. It is not worth it. It only drains you out and makes you weak.

Get strong. Talk to you leaders at work about how this can work out. Get a plan. Then get the surgery and move on. All this talk over and over about the problem does not fix it.

You might be so surprised how this will turn out.

I'm not blaming the doc for anything! And no, I have done more research on this than you know becuase it's a major issue and affects over 10 years of my life and also my future. Everything I stated is in our contract. And the doctor knew what kind of paper I was asking about.

Like I stated before. I am almost positive that after I had a THR I would be able to return to work and be able to do anything required of me and needed in order to perform all the duties my particular job requires. But, there is a clause in our contract that states when returning to work after being out on temp disability the doctor MUST sign off on a paper stating 100% no restrictions. No matter what you feel like after surgery. And after all is healed. This is the problem. As no doctor I have asked yet is willing to sign such a paper. And this IS needed in order to even be allowed to return to work. Would they take me back knowing I have 10 years of service in and experienced and also do a specialized job that there is only me that does on my shift? Probally so. I am well liked also by management and co-workers. Would they bend the rules and ignore the contract just to satisfy my needs and allow me to return to work after all is healed from a THR? I am not so sure about that one. Especially since we have been bought out by a French firm. And they are very strict about following the rules and the contract agreements between the UAW and General Motors, and us.

Could you explain why you're so desperate to hold on to this job, knowing that it may cause complications to your health? I simply can't understand it, and I have left jobs with 10 years or more of tenure for reasons of principle, not medical reasons.

No doctor will sign the kind of release you describe, simply because a person after THR is considered handicapped, and the physician could lose his license for signing it. Trust me, the doctor's professional standing is more important to him/her than a single patient.

Get used to the idea that you will have limitations, and retrain for something that can provide a living while not going outside the limitations you will have to live with.

Maybe I'm the one who's dense here, but many of us have changed jobs and even professions with less fanfare than you have. A job, even one you love, is still only a way to make a living, not a way of life.

But, there is a clause in our contract that states when returning to work after being out on temp disability the doctor MUST sign off on a paper stating 100% no restrictions. No matter what you feel like after surgery. And after all is healed. This is the problem. As no doctor I have asked yet is willing to sign such a paper. And this IS needed in order to even be allowed to return to work. Would they take me back knowing I have 10 years of service in and experienced and also do a specialized job that there is only me that does on my shift? Probally so. I am well liked also by management and co-workers. Would they bend the rules and ignore the contract just to satisfy my needs and allow me to return to work after all is healed from a THR? I am not so sure about that one. Especially since we have been bought out by a French firm. And they are very strict about following the rules and the contract agreements between the UAW and General Motors, and us.

curiosity.

After having two hips replaced, I still don't consider myself disabled, although

I know

others would consider me so.

This brings me to some questions I have had. What types of activities should we

not be

doing? I moved a bed the other day and thought later that perhaps I shouldn't

have?
