The short answer to the question is that " dwarfism, " specifically achondroplastic dwarfism (although certainly other forms as well) is considered an " impairment, " meaning, an underlying " defect, disorder, or other physical abnormality " (Yuck). However, even though it's an *impairment*, whether or not it is considered a *disability* depends on several factors, such as, does the person have trouble performing tasks that " normal " people perform? (Is the impairment " substantially limiting " ?) Does the person have a record of substantially limiting impairment or is he or she generally regarded has having substantially limiting impairment. In other words, determining whether your dwarfism is a disability (for the purposes of the ADA) is done on a case by case basis. There is no set answer to the question. Sorry. The EEOC manual, Section 902, goes into detail on the subject of how to define disability. You can find it at: http://www.eeoc.gov/docs/902cm.html Some excerpts: 16.The mere presence of an impairment does not automatically mean that an individual has a disability. Guest guest Posted November 5, 2001 Report Share Posted November 5, 2001 Based on my somewhat limited understanding of the ADA, the ADA does not define or stipulate certain groups or conditions as being " disabled. " The presents a mechanism for determining if a particular individual, in a particular time and place, has a significant limitation in a major life activity (walking, standing for long periods of time, reaching, etc.) that warrants reasonable accommodation to be made.
