Prosecutors today said that the February murder of a Indiana man in the offices of a trucking company near Burr Ridge happened "because the defendant, the victim's boss, was stressed out at work and was angry because the victim went over his head."

Dragos, 38, of Highland, Ind., was found in a closet on Feb. 9, 2009, in the offices of Saia Inc., in the 15W400 block of Frontage Road, near Burr Ridge, with a fatal single gunshot wound in the back of the head.

His immediate boss, Gilbert, 45, of the 4400 block of North Parkside Avenue, Chicago, has been charged with the murder.

After hearing details of the case today, DuPage County Judge Bakalis said the circumstantial case against Gilbert was "very strong," but still ordered a $5 million bail to replace the no-bail order that has kept Gilbert in the county jail since his March arrest.

Assistant DuPage County State's Atty. ph Ruggiero told Bakalis that police believe the victim was shot between 10:20 a.m. and 10:29 a.m. on Feb. 8 and that within minutes of the murder, Gilbert had manufactured a resignation letter on the victim's behalf and circulated it through the company's e-mail.

Ruggiero said that Dragos was shot with a .40-caliber weapon and that Gilbert used to own the type of weapon when he was a part-time police officer in the Chicago-area south suburb of Phoenix in 2001. He also said that there was evidence that after Dragos' death, Gilbert drove around the Chicago area for several hours, at one point throwing something into a garbage can at a tollway oasis and then having his car detailed and its carpet cleaned.

Ruggiero said that the defendant has a history that included alcohol and cocaine dependence, but was unable to declare a motive other than the "victim went over his head."

Jed Stone, defense attorney, admitted that Gilbert, who has pleaded not guilty, was under psychiatric care, but said his treating physician stated he "showed no violent behavior and wasn't a threat."

Gilbert was not expected to quickly post the necessary $500,000 cash to be released.
