The regulation affects all healthcare personnel, both paid and unpaid, who interact with patients in hospitals, diagnostic and treatment centers, certified home health agencies, long-term healthcare programs, AIDS home care programs, licensed home care services, and hospices. It does not affect nursing home personnel; an immunization mandate for them would have to be enacted through legislation. The regulation includes all medical staff, contract staff, and students who either have direct patient contact or contact with employees closely working with patients or residents. Healthcare personnel will be exempt from vaccination only if a physician or nurse practitioner certifies that it is medically contraindicated for that individual. While the New York State Nurses Association recommends that nurses choose to be immunized for the flu, it opposes mandatory immunizations. We need your help in contacting the Health Commissioner to urge him to rescind the emergency regulation mandating health care providers, as a condition of employment, be vaccinated against the seasonal influenza and H1N1 virus. A draft letter has been attached below-- simply copy and paste the letter into the body of your email and send it directly to the Department of Health at dohweb@.... Please take the time to email this to the Health Commissioner today! Dear Commissioner Daines, As a Registered Nurse in NYS, I am opposed to the emergency regulation mandating that healthcare facility personnel be vaccinated for seasonal influenza, and the H1N1 virus. My opposition is based on the following: 1) The seasonal flu vaccine is not 100% effective and sometimes is highly ineffective, as it was in 2005 and again in 2007. There is no guarantee that in any given year, the public will benefit from mandatory immunization of healthcare providers. Even with the flu shot, the person may still contract the flu virus. 2) The regulation does not provide for religious and philosophical objections. 3) The H1N1 vaccine has not been fully tested. 4) The right to refuse vaccination must be balanced against the efficacy in preventing different strains of influenza, the loss of civil liberty, as well as its safety. 5) The mandatory vaccination of health care professionals is a weak public health strategy to prevent the spread of the influenza virus when in fact the flu virus circulates in the community first. I believe the resources would be better deployed in the community as a means of more effective control. 6) The focus on the mandatory vaccination as a term and condition of employment detracts from what should be a real and comprehensive approach to curtail the spread of the virus. 7) There is already a critical shortage of nurses in NYS and this regulation may worsen the shortage by terminating nurses or forcing others to retire for choosing not to be vaccinated. I urge you to withdraw the emergency regulation mandating healthcare personnel to receive the flu vaccinations and instead convene a task force of stakeholders to assist in developing an approach that will achieve the desired outcome.
