I was denied a couple of months ago but I have

appealed it this is the 2nd go round.

Yes, Yes and Yes - every denial my husband got from social security said they

had determined that his condition was not severe enough to keep him from

working and then went on to say that based on his age, education and past

work experience, he was still able to perform other work.

Second one said considering the restrictions of his condition, individually

and combined, he could not do the jobs he had done in the past however the

evidence showed he was able to carry out most activities and went on to add

the sentence about his age ect again and that he was capable of performing

other work and he did not meet the requirements for disability benefits.

The Judge decided differently on July 26th and he will receive social

security now.

A friend of ours with the same illness was told since she had made salads at

a restaurant at one time that she was still able to do that now and was

denied because of age ect ect ect. The age education and past work history

sentence is always added.

You are not alone - they are hoping that you will give up and not pursue it

but do and you will get a hearing eventually and with the right documents

will get it then. DO NOT GIVE UP that is what they want.

etc that accompanies HCV-unfortunately they don't. HCV is still known as a

liver disease. I have rarely seen any mention of these in the public ads

regardig HCV, only what it does to the liver! You will have to fight

another fight. Do you have a lawyer that specializes in SS? They will take

your case on with no money up front-but they will get a chunck when the SS

finally does come through. My husband did and it still took several years

to get SS. I have seen in a couple hep sites areas that give advice, have

worksheets, etc on getting SS benefits. Try Hep-central first, I'm sure

they have a section there.

Keep it up and you will surely get a response soon - they say attorneys will

help you but not until they owe you at least $16,000 or more in back social

security pay because then the chunck they get is worth their time and you

usually do most of the work. My husbands doctor was the one who told us not

to get an attorney that he would help us out with it and he did along with

all the other letters we had from family and friends that knew my husband

before he got real sick and afterwards when he started the treatment and it

made him sicker. It took us 11 months to get the hearing and the final

approval which was better then 2 or 3 years and we get all the back pay not

some attorney.

Thanks for telling me about the CDC and the making of salads with Hep C maybe

that will help her some in getting her social security on down the road she

is in the middle of her 2nd appeal and it just goes on. Don't give up that

is really what they want you to do as I said before. It will be worth it in

the long run for you.

We found the Judge shaking his head like what are they wasting my time for

here when you should have been approved already - the system like all systems

is crazy and long and drawn out. I know alot of people go in there and try

to screw the system but we all have legitimate reasons to get it and like my

husband would rather be working then sick like he is. The Judge asked us why

we picked the date of Sept 1 of 99 and we told the truth it was when he could

not work at all any more even though he had missed plenty of work before then

with the skin disease from the Hep C and he seemed releived that we were not

trying to get any more then we deserved. There are to many people out there

that ruin it for the ones that are honest and need the disibility to survive

and have worked all of their lives. We saw plenty of that there while we

were waiting to see the Judge last month. Stay positive!!!!!

I am going to try to post this again. My first one

is out in e mail heaven somewhere.

I worked in the field of Engineering Design. I was

having frequent nosebleeds at work. This was before I

found out I had Hep C. I was unable to get out of bed

some mornings and if I pushed myself and did go into

work. I would have a nosebleed.

I had to fight my works insurance carrier a couple

times now for my long term disability. I receive

about 1/3 of what I made.

A guy came to see me in Clearwater under the guise

of helping me. He was just there to take info on me.

He questioned me about drugs, and sexual activity. I

told him I did not get the Hep C from that, I received

it along with 28 pints of blood. His main objective

was to get info and put me on a list at CDC as a known

carrier of Hep C. This is about the Girl who made

Salads........He told me that people with Hep C are

not allowed to work in the food industry along with

other places.

I am not going to give up I have already filed an

appeal. I have an e mai address that SS gave me that

is suppose to be Apfel's. I e mail it religously

every Sunday and have done so since May 2000. I have

never received a response. I do it anyway. I have

asked if they have a problem with literacy, and that I

think there must be someone in that office who can

read. I keep e mailing them till maybe I am big

enough of a pest that they will answer me. I also

know that I am being a smart ass to them but that is

my main objective. I can see it now on Monday

mornings....lol...... " Damn there is another e mail

from that Smart Ass Dickson. "

My reply to them would be, " Is it is better to be a

Dear Connie,

The easiest way to have them review a denial is to make a series of

appointments with a psychologist. The Navy has a rule that if you have a

potential terminal disease, you must see either a psychiatrist or

psychologist. Turns out that's a good rule, because my SS went through with

no problems whatsoever. My private disability policy, however, is a
