My husband and I are in the process of adopting a child from the state of California--we live in another state. This child is also our grandchild and as of this moment we have de facto parent status of him. The issue of vaccination has come up in the discussions with the social workers from California. We vehemently oppose vaccination of any kind while they are equally opposed to our position. What legal recourse do we have, if any, to prevent mandatory vaccination during the process of the adoption? Any information offered will be greatly appreciated. Iut I can tell you I have met a lot of people that have had kids in the system, and if the child was taken from the parents and put into foster care etc it will be hell to not VAX. I have met several families in Cali that have had there kids taken for not vaxing (medical neglect so they say) and haven't seen their kids again. From what I have seen the CPS is a very corrupt org and unless you can afford a real great lawyer I would at this point just smile and nod like you were going to VAX him as soon as he gets to your state and just not bring it up again or they may change their minds about giving him to you. -- Seeking legal information on how to refuse forced vaccination of child Hi all, I am new to this forum and have a question to ask that I hope someone can answer for me. Guest guest Posted December 15, 2010 Report Share Posted December 15, 2010 Speaking to this matter generally and not offering legal advice to you specifically, questions about exemptions for children during the adoption process most likely boil down to who has the authority to make the decision at what point in the process, and what the legal residence of the child is at that point as to what state's laws apply. Adoptive parents should address the first question with their local adoption attorney, and review the applicable exemption laws for the point at which they have that legal decision-making authority. If someone other than the adoptive parents has legal authority to make the decision at some point, that doesn't necessarily mean they can't or won't honor the adoptive parents' wishes, but it may give them the right to override the parents' wishes if they and the parents disagree on the matter. But they can't cooperate with the adoptive parents' wishes unless the parents let their wishes be known, so the matter should be discussed early on in the process, ideally. Hope this is helpful. Guest guest Posted December 16, 2010 Report Share Posted December 16, 2010 Just to say that my friend adopted a little girl and was against vaccination but she did not make an issue of it, when all the Paper work was finished all the legal stuff sorted she armed herself with all the information so if she was approached by the doctor she new what she was talking about, in this way you hopefully can slip through the net.
