Jane,

I am not sure that you are aware....and I thought the same thing till I was

granted benefits...from the date they call you disabled.....which is 6 months

after the last day you worked....then add 24 months....so if it takes 3 years to

get your claim approved voila you already have medicare benefits which will

back pay your medical.  They really dont explaiu that and had gotten engaged

because I thought my cobra insurance would run out.....I applied for the first

time the end of February 2007 and before I had heard anything about my claim

 my fiance said uh, there is a whole lot of money in your account after he

deposited a check for me......my backpay was deposited in less then  8 weeks

after I applied.

I applied on line....my date of onset of disability was august 05 (i waited to

apply for SSD because i was in the process of a divorce and it would have been

considered marital property)   I didnt realize that my minor children were

entitlted to benefits until I spoke with a woman on the internet.....I wasnt

told that at my 10 minute office appointment....

Obviously, your situation has been more difficult then mine related to the

benefits.  I am shocked that the GA doc could fire you....I would think that

you would be covered by FMLA...so that you would have been entitled to std or

ltd....

There was a member of another listserv telling members that they will have to go

to all of these social security docs etc....I never had to see one of their

docs....the fact of it is people that have cases where its not definitive...most

of them give up or when they are finally granted benefits with a more recent

date of onset they stop appealing.....

As far as people dying before getting benefits.....SSA just added 32 diagnosis

that with any of these diagnosis one will get immediate called compassionate

care its listed under new impairments.....they always did this for ALS and acute

renal failure (they had immediate medicare as well) with these new diagnosis

because of the severity these new illness's get immediate benefits.

As far as SSI I have limited knowledge as I have never qualified for it.....I

only have knowledge in dealing with patients applying for it......

 My ex fiance's brother was a gaurd in colorado and was stabbed or something

like that and ended up with hep c....and I became friend with a woman who was a

police officer that had hep c...did the year of treatments and has completely

recovered from the hep c but now has been diagnosed with MS....i know the

treatment sucks....

Deb,

   According to SS since my " lover " and I are not married so his income does

not count against my getting SSI. It does though for foodstamps and a few other

state programs.He is on disability himself,so no, even if we were to marry I

would still not have healthcare.

  My last job was with the GA. Dept. of Corrections. As a condition of

employment I had to be physically fit to retain the job. They were not in

violation of the law.

  My understanding is not incorrect. I have been through this process with a

former husband, my current " lover " and my mother, all of which I handled most of

the correspondence between them and SS due to their poor health. I am more than

familiar with how SS works. The form you spoke of has been completed as has a

range of motion report done by a doctor that SS sent me too. Yes I agree the

narrative from my doctor is not enough but it with all the other evidence is

more than enough. I have read the SS's list of impairments and by their

own admission I qualify for SSD with 3 firm impairments (muscoskeletal) not

including several other impairments that are on the brink of qualifying.

  I have been through 10 months of a 12 month combination therapy for Hep C. It

had to be stopped early because of a dangerous drop in white and red cells as

well as elevated amonia, bilurubin, etc. According to the last blood work my

liver was not any worse but no better than it was 3 years ago when I completed

the treatment.

  I have known people with AIDS, terminal cancers, etc. who had lawyers and

died before getting approved for SSD. Just because you meet their guidelines

does not mean you will automatically be approved. They prolong this process in

hopes that you will either die or have to take some form of work to afford food

and other necessities.

  I will eventually get SSD but it will take a while longer to get it. After it

is approved it will still be 24 months before I am able to get Medicare. Makes

sense, why should a medically disabled person need immediate medical care

anyway? In the process I will lose much of what I have amassed through my

lifetime. I have already had to sell my jewelry and many of my collectibles and

I am sure I will have to sell more before it is over. This is causing a strain

in my relationship with my " lover " (the best man I have ever known), my family

and my friends. I firmly stand by my earlier comment that this country sucks. I

have worked since I was 16 years old and paid into SS out of every paycheck yet

now that I need help it is not there. I had to rant a little too!

SSI is strictly for indigent, if you were not given SSI it would be because you

or your spouse make too much money, and for that reason you would not qualify

for medicaid,.

You do not need to be disabled to be on SSI, but if you do not have enough work

credits, and are disabled you can be approved, if that makes sense.  Although,

the approval really has nothing to do with disability it has to due with

indigence, if that makes any sense.

SSD is for disabiltiy.. ...the problem is that SSD doesnt recognize migraines as

a disabling condition and therefore... ..no matter how many docs diagnose

migraine doesnt really matter....it is not considered disabling... for further

info see the blue book and the red book.  I dont want to delfate your hope in

gaining/winning a claim but, as SSA is set up now, its not going to happen.

Thanks Debra for the wishes. I need them.

I first applied in April of 08, was denied in April of 09 and

immediately filed an appeal using an attorney. The first

attorney was a screw up and I switched attorneys the

first of October. My attorney seems to think there won't

be a problem with the decision based on the medical

evidence but you just never know. My hearing before

the ALJ is a video one. Not sure if that's good or bad.

I believe that I have some tips for a hearing in one of my files...I will see if

i can find them.  From what I have been reading the past couple of hours, your

chances are excellent, at the ALJ level.  The judges are not medically

trained and I think they err on the side of the claimant.  So many people give

up prior to that level. 

Why did the first rejection take a year?  Everything I just read stated its

usually denied within 4 months.....well if you are approved and your onset of

disability was april of 08 you wont have to wait very long if you are approved

to get medicare.

If SSA sends you to one of their physicians, does SSA pay for it or does the

patient pay for it?  Does anyone know the answer to this?

What the MRI said in September ... " Moderate to severe multilevel degenerative

cervical spondylotic changes, most significant at C5-C-6 and C-6-C-7, where

there was central canal stenosis and significant bilateral neural foraminal

stenosis.

Superimposed disc protrusion was not excluded, particularly at C-5-C-6 " .

That's just cervical... then there's the mess in the lumbar region... basically

the same.

My right arm and hand are in pain 24/7 with numbness, tingling and burning

pain. I'm on Lyrica which just takes the edge off. Some days I think about

just cutting the whole arm off. It's basically useless at this point. Of

course,

I'm right hand dominant. I type with my left hand and I can't hold a pen,

fork, knife, etc. Peachy.

Oh yeah... and I had a mild cerebellar stroke Nov 08. Still have balance

and eye issues from that.

Anyway... if SSA sends you to one of their physicians for an eval..it's

their dime. Keep in mind that physician is not there to help you...they

are there to disprove your claim.

What the MRI said in September ... " Moderate to severe multilevel degenerative

cervical spondylotic changes, most significant at C5-C-6 and C-6-C-7, where

there was central canal stenosis and significant bilateral neural foraminal

stenosis.

Superimposed disc protrusion was not excluded, particularly at C-5-C-6 " .

That's just cervical... then there's the mess in the lumbar region... basically

the same.

My right arm and hand are in pain 24/7 with numbness, tingling and burning

pain. I'm on Lyrica which just takes the edge off. Some days I think about

just cutting the whole arm off. It's basically useless at this point. Of

course,

I'm right hand dominant. I type with my left hand and I can't hold a pen,

fork, knife, etc. Peachy.

Oh yeah... and I had a mild cerebellar stroke Nov 08. Still have balance

and eye issues from that.

Anyway... if SSA sends you to one of their physicians for an eval..it's

their dime. Keep in mind that physician is not there to help you...they

are there to disprove your claim.

that hard. It goes by income. Almost everyone i know in my state is on that.

Once you get on that, it pays for doctor visits. Then you can try different

out a five page form, list my medical history, what the injury was etc. I

qualified as disabled. But that is state not federal like ssi.But ususally it

Social Security pays for it. They also pay mileage to & from the appt..

SSI is strictly for indigent, if you were not given SSI it would be because you

or your spouse make too much money, and for that reason you would not qualify

for medicaid,.

You do not need to be disabled to be on SSI, but if you do not have enough work

credits, and are disabled you can be approved, if that makes sense. Although,

the approval really has nothing to do with disability it has to due with

indigence, if that makes any sense.

SSD is for disabiltiy.. ...the problem is that SSD doesnt recognize migraines as

a disabling condition and therefore... ..no matter how many docs diagnose

migraine doesnt really matter....it is not considered disabling... for further

info see the blue book and the red book. I dont want to delfate your hope in

gaining/winning a claim but, as SSA is set up now, its not going to happen.

ine,

I don't remember if you said you had insurance or not...but when you

are approved you may want to think about a spinal cord stimulator.  I have one

and it broke the cycle of pain that I had, in fact i no longer turn it on very

often.  I refer to mine as a g-dsend.

Did I understand you correctly, that you arent taking any pain medicine other

then lyrica?

No, no insurance. I've never heard of a spinal cord

stimulator but I'll look it up.

I take: Lyrica to deaden the nerve pain, Ultram and Vicodin

for pain, Flexeril for muscle pain, and Carbamazepin for

Trigeminal Neuralgia. Plus high blood pressure meds and

Prilosec for GERD.

I've considered a lovely bottle of Traverse City Cherry

wine but I've had one experience with mixing Lyrica

and alcohol and I really don't want a repeat...but

it does sound so good and it would help to stop

the pain... last time I was unconscious and non-responsive.

I cant figure out why lyrica is a controlled drug....anyone know y?...you have

trigeminal neuralgia as well.....I had a very brief incident with that years

ago....My heart goes out to you.....does mixing alcohol and lyrica always have

that ending?  Lets avoid that one then.....

SSI is strictly for indigent, if you were not given SSI it would be because you

or your spouse make too much money, and for that reason you would not qualify

for medicaid,.

You do not need to be disabled to be on SSI, but if you do not have enough work

credits, and are disabled you can be approved, if that makes sense. Although,

the approval really has nothing to do with disability it has to due with

indigence, if that makes any sense.

SSD is for disabiltiy.. ...the problem is that SSD doesnt recognize migraines as

a disabling condition and therefore... ..no matter how many docs diagnose

migraine doesnt really matter....it is not considered disabling... for further

info see the blue book and the red book. I dont want to delfate your hope in

gaining/winning a claim but, as SSA is set up now, its not going to happen.

What the MRI said in September ... " Moderate to severe multilevel degenerative

cervical spondylotic changes, most significant at C5-C-6 and C-6-C-7, where

there was central canal stenosis and significant bilateral neural foraminal

stenosis.

Superimposed disc protrusion was not excluded, particularly at C-5-C-6 " .

That's just cervical... then there's the mess in the lumbar region... basically

the same.

My right arm and hand are in pain 24/7 with numbness, tingling and burning

pain. I'm on Lyrica which just takes the edge off. Some days I think about

just cutting the whole arm off. It's basically useless at this point. Of course,

I'm right hand dominant. I type with my left hand and I can't hold a pen,

fork, knife, etc. Peachy.

Oh yeah... and I had a mild cerebellar stroke Nov 08. Still have balance

and eye issues from that.

Anyway... if SSA sends you to one of their physicians for an eval..it's

their dime. Keep in mind that physician is not there to help you...they

are there to disprove your claim.

I would no longer need pain meds as  I have zero back, leg  pain....however I

have RA and crohns as well, so I will always be on a opiate to control the side

effects of the crohns.  Will you still need narcotics, maybe not

daily,you may be able to wean off long acting drugs and just take prn medicine

if you are having a bad day....talk to your doc before hand and find out his

plan as a  a 50 percent reduction in pain doesnt always equate with a 50

percent reduction in meds.....

May I add that yes. Absolutely the SSI doctor is there to deny you.. Make

sure to put on your worst face..

You need to really think about the question " what is an average day like "

as well...

This will be used to show how much activity is left in day..

Lyrica may be controlled because of the side effects?

I don't know.

I did not intend to drink much but I was at a Christmas

party and my daughter's friends were mixing drinks...

trying different combos and you know.. it was here

try this...take a sip...here try this...take another sip

and before you know it I had too many sips and

was out cold. My blood alcohol level was .13

The ER was surprised because they figured it would

come back much higher because of my condition

upon arrival. What an eye opener.

Yes, I have Trigeminal Neuralgia but it's being controlled

with Carbamazepine, thank goodness. Worse pain I have

ever felt in my life and that's saying something because

I'm in pain 24/7 in my right arm and hand.. and back...

cripes. Just shoot me.

Once you get on that, it pays for doctor visits. Then you can try different

doctors. it even covers chiropractic type doctors.Free medicines etc.

If you though those were serious...I would hate to tell you what I am

on....enough to kill a horse, a man, and several small children,,,,and I do

just fine.....I think ine is probably hanging on by her

fingernails.....ine it certainly sounds lke your pain in

undercontrolled,,,sounds like a long acting drug oxycontin or ms contin would do

you a world of good......talk to your doc....ultram is pretty expensive

too...why use vicodin and ultram...the whole purpose of ultram is non

narcotic....it doesnt make sense....
