You do not need to be disabled to be on SSI, but if you do not have enough work credits, and are disabled you can be approved, if that makes sense. Although, the approval really has nothing to do with disability it has to due with indigence, if that makes any sense. SSD is for disabiltiy.....the problem is that SSD doesnt recognize migraines as a disabling condition and therefore.....no matter how many docs diagnose migraine doesnt really matter....it is not considered disabling...for further info see the blue book and the red book. I dont want to delfate your hope in gaining/winning a claim but, as SSA is set up now, its not going to happen. I had to fill out a five page form, list my medical history, what the injury was etc. I qualified as disabled. They will look at your case and tell you if, in fact, you have a case and then they will represent you with no money up front. They only get paid if you win, so most of them will not take your case unless you have one. That would be a good indicator for you as to what you need to do next. If you need to start a new claim, do it. The longer you wait, the longer it's going to be before you get disability. If you need current medical records go to free clinics. I originally applied for SSI & SSD. At some point SS dropped the SSI claim, according to my attorney, and the SSD claim is still pending. I don't have an income. My " friend " is paying all the bills. I do not understand why they dropped it and I can't get anyone to tell me why or even say that it was done. I don't know how it is in other states (I am in Georgia) but you don't get SSI until you are approved for SSD and then if you qualify financially you get it retroactive when you get SSD. You cannot get medicaid here until you are proven disabled by SS then if you don't have minor children you are put in a " spend down mode " where you have to accumulate a percentage of your income in medical bills before they will pay. If you don't have money to see doctors you cannot get medical evidence to submit to SS. But you can't get SSD without medical evidence. I had short term disability for 5 months and health insurance for 1 of those until I was terminated because I was disabled. During that month I saw an orthopedist 2 times, got 1 MRI, and saw my GP 4 times. There was not enough time to see anyone else before the insurance stopped. Luckily my orthopedists wrote a very good narrative stating that I am completely & permanantly disabled and why. I have thought of writing a book when this is all over about how to work the system so disabled people can afford to live during the interminable SSD waiting period. I have never believed in dishonesty and I have always believed in working hard but when these methods don't work, and they don't with SS, other methods have to be employed. During this process I learned too late what needed to be done at every step. Off topic: I have significant scarring of my liver due to Hep C. My feet and legs stay swollen 24/7 to the point my balance is off because my feet are not flat but more rounded. I take aldactone and it reduces it some. I went to the ER when I started having difficulty breathing as a result. Long story short, in the attending Dr.'s notes (he did not see fit to tell me this, ?) he said it was probably from the early stages of liver failure (hmm, that can't be good). My GP and all the others I have called cannot treat me for this but will send me to a specialist. The specialists demand at least $300.00 up front to see me. I have been that route and they keep you coming for 4-6 visits before they tell you anything concrete about how you are doing let alone treat you. Even if I had good insurance, at this point I couldn't afford the co-pays. Guest guest Posted February 27, 2010 Report Share Posted February 27, 2010 Jane, I disagree that this country sucks and for those that dont like it.....they can feel free to move. Your male friend, if he pays all of the bills is not a " friend " but a lover, and he is supporting you.....that is why you were not considered indigent. Yes, the first stages of liver failure causes the swelling that you are experiencing. due to the problems with protein etc.....if it were me,,,,,and i was in that situation, and IF he, your friend had good insurance....I think I would talk about getting married for some period of time.....if nothing else to get you the medical care you need...... Did you file FMLA paperwork? (Assuming that your company had more then 40-50 people) How long ago did this happen? If you were fired, and you worked for a large company they violated the law.... Your understanding of SSI and SSD is incorrect. Please call SSA and ask them to explain., UNFORTUNATLY your doc writing in the chart that you are disabled completely and why is NOT enough, There is a form that must be filled out with specific answers...how long you can sit, stand lift a 10 lb box, stoop, it is an entire page I believe it is called...geez I can not remember.  A narrative will not cut it. As far as your liver, did you ever go thru the treatment for the hep c? The requirments for SSD qualification under SSD are pretty stringent and involve repeated lab work, hospitalizations, and transfusions.  And, I was shocked but after liver transplantation, benefits are for 1 year. After that, one is not considered disabled. The problem with our world today is too many people see themselves as " disabled " . They believe that their one bulging disc has disabled them.  I find it even more humerous the people I have talked to that bitch and complain that they cant get SSD and they dont understand why, when they have never worked. I had a friend that was diagnosed with MS, and she went down hill very quickly. She is now a quadraplegic...her comment after diagnosis, was she was happy cause she would be able to get disability. Her daughter was 12 and the last time she worked was the year before she was born. That was a horrible circumstance, especially since they got an attorney and the attorney wasnt honest with them. They thought they would get a big pack pay check,,,,,they went and bought an expensive house before they sold the first one....what ended up happening.....they divorced, foreclosed on her house, and yes she gets ssi a small check that doesnt begin to pay for her care............ Anyway.....just my thoughts....or my rantings i should say.... Almost everyone i know in my state is on that. Once you get on that, it pays for doctor visits. Then you can try different doctors. it even covers chiropractic type doctors.Free medicines etc. I was on it before. I applied for medicaid based on disablility. I had to fill out a five page form, list my medical history, what the injury was etc. I qualified as disabled. I have to agree, parts of this country sucks, the government is out of control, some cities are dangerous to live in because of gangs. I've visited other countries and they weren't as dangerous to be in and people had health care and weren't unable to feed their families. Good people can't find jobs to support their families. More people qualify for food stamps now than ever before. My husband's income was enough to support us until last year when prices of everything went up. When I was living with my male friend, I was approved for SSD. His income was not considered in my application. Friends aren't obligated to support their friends that they offer a home to. He generally told me what to expect and told me that they won't look at the specifics of my case and decide whether to represent me until after the first denial. That firm won't help me prepare my case before that denial. I talked to another attorney at that firm in October after being denied and she told me that they won't represent me unless I have VERY regular doctor visits - i.e. every month. Guest guest Posted February 27, 2010 Report Share Posted February 27, 2010 The attornies do not want to file initial claims. You dont need an attorney to tell you if you have a claim.  Either your medical claim meets the burden of proof for disability or it does not., If you have only 1 illness, it is pretty cut and dried. Either you have the problems as listed or you dont. Either you have had the necessary testing or you havent. Guest guest Posted February 27, 2010 Report Share Posted February 27, 2010 Deb,   According to SS since my " lover " and I are not married so his income does not count against my getting SSI. It does though for foodstamps and a few other state programs.He is on disability himself,so no, even if we were to marry I would still not have healthcare.  My last job was with the GA. Dept. of Corrections. As a condition of employment I had to be physically fit to retain the job. They were not in violation of the law.  My understanding is not incorrect. I have been through this process with a former husband, my current " lover " and my mother, all of which I handled most of the correspondence between them and SS due to their poor health. I am more than familiar with how SS works. The form you spoke of has been completed as has a range of motion report done by a doctor that SS sent me too. Yes I agree the narrative from my doctor is not enough but it with all the other evidence is more than enough. I have read the SS's list of impairments and by their own admission I qualify for SSD with 3 firm impairments (muscoskeletal) not including several other impairments that are on the brink of qualifying.  I have been through 10 months of a 12 month combination therapy for Hep C. It had to be stopped early because of a dangerous drop in white and red cells as well as elevated amonia, bilurubin, etc. According to the last blood work my liver was not any worse but no better than it was 3 years ago when I completed the treatment.  I have known people with AIDS, terminal cancers, etc. who had lawyers and died before getting approved for SSD. Just because you meet their guidelines does not mean you will automatically be approved. They prolong this process in hopes that you will either die or have to take some form of work to afford food and other necessities.  I will eventually get SSD but it will take a while longer to get it. After it is approved it will still be 24 months before I am able to get Medicare. Makes sense, why should a medically disabled person need immediate medical care anyway? In the process I will lose much of what I have amassed through my lifetime. I have already had to sell my jewelry and many of my collectibles and I am sure I will have to sell more before it is over. This is causing a strain in my relationship with my " lover " (the best man I have ever known), my family and my friends. I firmly stand by my earlier comment that this country sucks. I have worked since I was 16 years old and paid into SS out of every paycheck yet now that I need help it is not there. I had to rant a little too!  Jane H. You do not need to be disabled to be on SSI, but if you do not have enough work credits, and are disabled you can be approved, if that makes sense. Although, the approval really has nothing to do with disability it has to due with indigence, if that makes any sense. SSD is for disabiltiy.. ...the problem is that SSD doesnt recognize migraines as a disabling condition and therefore... ..no matter how many docs diagnose migraine doesnt really matter....it is not considered disabling... for further info see the blue book and the red book. I dont want to delfate your hope in gaining/winning a claim but, as SSA is set up now, its not going to happen. Once you get on that, it pays for doctor visits. Then you can try different doctors. it even covers chiropractic type doctors.Free medicines etc. I was on it before. I applied for medicaid based on disablility. I had to fill out a five page form, list my medical history, what the injury was etc. I qualified as disabled. Guest guest Posted February 27, 2010 Report Share Posted February 27, 2010 Jane, I am not sure that you are aware....and I thought the same thing till I was granted benefits...from the date they call you disabled.....which is 6 months after the last day you worked....then add 24 months....so if it takes 3 years to get your claim approved voila you already have medicare benefits which will back pay your medical. They really dont explaiu that and had gotten engaged because I thought my cobra insurance would run out.....I applied for the first time the end of February 2007 and before I had heard anything about my claim  my fiance said uh, there is a whole lot of money in your account after he deposited a check for me......my backpay was deposited in less then 8 weeks after I applied. I applied on line....my date of onset of disability was august 05 (i waited to apply for SSD because i was in the process of a divorce and it would have been considered marital property)  I didnt realize that my minor children were entitlted to benefits until I spoke with a woman on the internet.....I wasnt told that at my 10 minute office appointment.... Obviously, your situation has been more difficult then mine related to the benefits. I am shocked that the GA doc could fire you....I would think that you would be covered by FMLA...so that you would have been entitled to std or ltd.... There was a member of another listserv telling members that they will have to go to all of these social security docs etc....I never had to see one of their docs....the fact of it is people that have cases where its not definitive...most of them give up or when they are finally granted benefits with a more recent date of onset they stop appealing..... As far as people dying before getting benefits.....SSA just added 32 diagnosis that with any of these diagnosis one will get immediate called compassionate care its listed under new impairments.....they always did this for ALS and acute renal failure (they had immediate medicare as well) with these new diagnosis because of the severity these new illness's get immediate benefits. As far as SSI I have limited knowledge as I have never qualified for it.....I only have knowledge in dealing with patients applying for it......  My ex fiance's brother was a gaurd in colorado and was stabbed or something like that and ended up with hep c....and I became friend with a woman who was a police officer that had hep c...did the year of treatments and has completely recovered from the hep c but now has been diagnosed with MS....i know the treatment sucks.... It does though for foodstamps and a few other state programs.He is on disability himself,so no, even if we were to marry I would still not have healthcare.  My last job was with the GA. Dept. of Corrections. As a condition of employment I had to be physically fit to retain the job. They were not in violation of the law.  My understanding is not incorrect. I have been through this process with a former husband, my current " lover " and my mother, all of which I handled most of the correspondence between them and SS due to their poor health. I am more than familiar with how SS works. The form you spoke of has been completed as has a range of motion report done by a doctor that SS sent me too. Yes I agree the narrative from my doctor is not enough but it with all the other evidence is more than enough. I have read the SS's list of impairments and by their own admission I qualify for SSD with 3 firm impairments (muscoskeletal) not including several other impairments that are on the brink of qualifying.  I have been through 10 months of a 12 month combination therapy for Hep C. It had to be stopped early because of a dangerous drop in white and red cells as well as elevated amonia, bilurubin, etc. According to the last blood work my liver was not any worse but no better than it was 3 years ago when I completed the treatment.  I have known people with AIDS, terminal cancers, etc. who had lawyers and died before getting approved for SSD. Just because you meet their guidelines does not mean you will automatically be approved. They prolong this process in hopes that you will either die or have to take some form of work to afford food and other necessities.  I will eventually get SSD but it will take a while longer to get it.
