In 1995 I applied for private insurance, i.e. not through my employer (wasn't working at the time). I was denied due to pre-existing conditions. Then with proof of that one denial I was able to apply to the state insurance for the uninsurable. I don't remember what it's called, but it's not medical assistance. I had to pay a monthly premium and copays. I wasn't that bad....the coverage was decent and I wasn't in an HMO. Eventually I got a job that provided benefits and was able to drop that insurance. I don't believe employers have the right to withhold medical insurance, although there are some pre-existing condition exemptions if you come in with no previous health insurance. This has been my experience. In MN the insurance company that denied me insurance included in my denial letter a phone number to contact the state insurance company for the uninsurable. Good luck.
