Vicki:

I was part of management at my last job. If your doctor releases you to go back to work for light duty you need a release from your doctor (a piece of paper from your doctor saying what you can or cannot do) inorder to return to work. Also the doctor needs to put on this release your next scheduled appointment. As long as you have this there is nothing your employer can do. Always make sure of what they want and need from you to keep your job secure. If you don't then your employer will have a loop hole to let you go. After each doctor visit make sure that he gives you an updated release saying what you can or cannot do until he releases you from his care. Also, always keep copies of what you hand in in a file for yourself. This is the best way to protect yourself. Let me know if you have any other questions.

I don't know if anyone can help me but its worth a shot. I am employed and been on short term disability due to my spinal fusion. I have been off since Feb.24. I asked my surgeon if i could go back to work. He said yes LIGHT DUTY. I do not go back to surgeon til JULY 28. My employer says we have stuff u can do til u go back to DR. but if he doesn't release you to do your job then a decision will have to be made about my job. CAN THEY FIRE ME IF I"M STILL UNDER A DRS. CARE??? HELP!!! I'm panicking.thanks Vicki

Thank you DIDI ! I have a work note stating all of that but my employer kinda made a threat today that if the Doc doesn't release me on the 28 of July to be able to do my original job, that my job /employment will be terminated. I'm waiting to hear back from a lawyer.Noni by Didi <nonibydidi@...> wrote:

That is the way to go. A lawyer can tell you how the laws read and once your employer knows that you are getting a lawyer they will watch their p's and q's more closely. No one wants to be sued. I wish you the best of luck,
