Remember, the dow bankruptcy is a completely separate process from what you have otherwise participated in (Global, Revised Settlement, MDL, state court, etc.). You may have filed a "proof of claim" form in the bankruptcy -- this is a standard bankruptcy document and simply serves to preserve your claim as a creditor in the bankruptcy. What they are talking about now is the claim form for the SETTLEMENT portion of the bankruptcy. Keep in mind, you will first have to choose to either opt into or opt out of the settlement (assuming the settlement is upheld on appeal). If you opt out of the settlement, you are put into the "litigation facility" where you litigate your claim against dow under strict parameters. If you opt in, you will submit your claim form, with the appropriate supporting documents for your claimed level of compensation. Your claim form will be processed and when, and if, the settlement is approved you will get paid whatever you are entitled to under the settlement. There is very little doubt that no matter what happens at the current level of appeal, this WILL go the the U.S. Supreme Court.
