According to Pierre Blais, there has been widespread reports of problems with this particular style, which was placed in after '93. While there is no class action now, he feels that the potential greatly exists because of the widespread reports of problems with this style. The implants were incorrectly manufactured and defective. The valve on these styles was made to the wrong dimension, thus allowing the for the potential of a leak from the valve. Pierre states this defect is NOT subtle. These implants are apparently still in use, and women are still having severe problems with them. Because my implants were contaminated with the 1 type of bacteria and 2 types of molds, I had these leaked into my systemic system because of the faulty valve. In addition, Pierre said that because of the defectiveness of this style, my implants were removed shortly before separation of key pieces which would have led to rapid deflation (within hrs), followed by a severe infective episode. When I brought this matter to the attention of my attorney, he felt that I had not only a good med mal case against the ps (he filled them with betadine in addition to saline, which is absolutely contraindicated, and he overfilled one of them, causing further weakening of the shell), but that I had a good case against McGhan, especially in light of all my health problems, which are documented as potentially being related to my implants. So, my attorney said that he would be willing to take on the case, as he has done 15 implant cases so far, and has won every single one of them, with 3 resulting in million dollar rewards for the women, and the others resulting in substantial monetary value. He is taking on more and more cases and agrees that the manufacturers of implants should be made to pay for the harm they are doing to women. Right now, any woman who has or had McGhan saline implants and is or was ill, is welcome to join the lawsuit. He is specifically going after McGhan now, but is willing to take on other cases against Mentor or other manufacturers if there are several women involved. Currently, I have 3 other women that have joined this lawsuit with me, with a 4th one probably going to join. , (my attorney), represents women in all the states, so where they live is not an issue. Not all the women have the style 468, but one does, and had hers implanted the same time I did, and had similar health problems. She is still waiting to get the results back from Pierre. But I strongly encourage any woman who has/had McGhan salines to contact me so that I can give her 's #. I think this is a great opportunity for us to make ourselves heard, as well as to let the manufacturers and plastic surgeons know that we are serious about our plight, and will not back down. will do the case on a contingency basis, so no retainer is required. However, any woman who has not had her implants analyzed will need to get that done. He feels that Pierre has "rock bottom" prices, and recommends that women send them off to him instead of sending them off to an independent lab. If a woman chooses to have send them off, then she will need to provide him with a retainer. He also needs med records, and again, if he gets them, then he needs money to do that, so he recommends that everyone just get them on their own, and save themselves some money. So, that is the scoop with the lawsuit. He is also networking with Kathy ley ston in MO, who is so happy that someone is willing to take on McGhan. is dead serious about going after them, and so am I, so we make a good pair. I had style 168 textured McGhans, and Dr. Blaise also analyzed my implants and found manufacturing defects in those, as well as mycobacterial contamination. He alluded to the fact that a class action lawsuit would be probable against McGhan, but when I wrote Toxic Discovery Network about the possibility of a class action, they indicated that they had no knowledge of one. I had checked out the possibility of filing a lawsuit myself, because of all the neurological symptoms I had, but was really discouraged by the attornies I called and wrote to. One, in fact, told me that he currently had a case against a naturopathic doctor, and his client was an implanted woman who was experiencing neurological problems, and she was blaming the doctor and his treatment for her symptoms! I hope my call made them think twice about blaming this poor guy. My statute of limitations has since run out, but I would be interested in talking to this attorney. Most manufacturer's have learned their way around in court, and it hasn't helped that the FDA has approved saline breast implants as of May 2000. They still claim that there is no evidence that implants cause disease. We know otherwise, but trying to prove that in court is a different matter, and very difficult.
