Thanks to several requests from list members,

group/medicaid/files/ has been totally reorganized.

I spent the weekend scanning transcripts into searchable pdf files.

As a family, to date we have had two hearings before an

Administrative Law Judge (ALJ). In Georgia, these are the only

evidentiary hearings--the only time evidence can be gathered.

Subsequent hearings/appeals can only refer to evidence gathered

during the ALJ hearing process.

The transcripts of Georgia Medicaid's expert witness testimony at

both the 2000 and 2006 hearings are available as searchable pdf

files. Despite the growing use of off-label use of HBOT for cp and

other brain-injuries, particularly autism, there is little difference

between the pediatric neurologists's testimony in 2000 and 2006.

Procedurally, during the 2000 hearing both direct and cross-

examination testimony was given live.

In 2006, the ALJ (same judge as in 2000) requested direct testimony

in written form. Direct testimony is elicited from the witnesses by

the attorney representing the witness's position.

For example, our attorney took direct testimony from Harch, Marois,

and Uszler.

The attorney for the Georgia Attorney General's office took the

direct testimony of Georgia's sole expert witness, pediatric

neurologist Dr .

The cross-examination testimony is elicited by the opposition

attorney. The state's attorney from the AG office cross-examined

Harch, Marois, and Uszler. Our attorney cross-examined .

Following cross-examination testimony, the attorneys are then allowed

to elicit re-direct testimony from " their " respective witnesses. The

AG's attorney re-directed ; our attorney re-directed Harch,

Marois, and Uszler.

This is all sworn testimony and can be used by any member of the

list for their own cases. You are strongly encouraged

to do so. That was one thing most desired by Drs. Harch, Marois, and

Uszler--that parents on the listserv take advantage

of this new resource in making the case for their children before

their state Medicaid agency.

This testimony can be used to torpedo both the Collet study and also

the AHRQ report.
