We can postpone the testing, if the testing physician feels that it will be detrimental to her health, but we can't move forward without it. I can' accept the claim just because she says she can't be tested. I was told by the OWCP physician that she was suppose to provide the testing information from her Mass Gen Hospital testing for his review. Has she done that? I could deny the claim and she could submit for reconsideration once she is able to be tested. In order to be reconsidered she would need to submit new medical info supporting her claim (which would be testing results and a medical opinion showing a definite causal relationship between her asthma and the exposure to mold in the federal work place). Denial at this time, would be the only thing left to do if she can't be tested or refuses the testing. But she would still have her appeal and reconsideration rights. From her e-mail, I conclude that her attending physician is not supporting her statement that she is medically unable to be tested? If she has medical reasons that prevents her from being tested, she needs to provide that to the testing physician. He will have to make the decision whether she is actually too sick to proceed with the testing. What ever she decides, the ball is in her court. I can't tell her what to do, this has to be her decision. Jerry D.
