I'm a little confused. SSI is Federal, Social Security. AS is

considered a disability. My son receives SSI. We live in Florida. I

had no trouble getting it for him at all.

112.10 Autistic Disorder and Other Pervasive Developmental Disorders:

Characterized by qualitative deficits in the development of reciprocal

social interaction, in the development of verbal and nonverbal

communication skills, and in imaginative activity. Often, there is a

markedly restricted repertoire of activities and interests, which

frequently are stereotyped and repetitive.

The required level of severity for these disorders is met when the

requirements in both A and B are satisfied.

A. Medically documented findings of the following:

1. For autistic disorder, all of the following:

a. Qualitative deficits in the development of reciprocal social

interaction;

and

b. Qualitative deficits in verbal and nonverbal communication and in

imaginative activity; and

c. Markedly restricted repertoire of activities and interests;

or

2. For other pervasive developmental disorders, both of the following:

a. Qualitative deficits in the development of reciprocal social

interaction;

and

b. Qualitative deficits in verbal and nonverbal communication and in

imaginative activity;

and

B. For older infants and toddlers (age 1 to attainment of age 3),

resulting in at least one of the appropriate age-group criteria in

paragraph B1 of 112.02; or, for children (age 3 to attainment of age

18), resulting in at least two of the appropriate age-group criteria in

paragraphs B2 of 112.02.

Social Security disabilty is only for the disabled that have once

worked and earned the " credits " .

SSI, Is for the disabled who have not earned the credits or for

children. You might want to apply for SSI. Remember, that any other

income is deducted from the SSI. For my son, out of 600.00 (I can't

remember what the max is) he only recieves 100.00 because of my

income.

SSI, is to " supplement "

I forgot to add. If your son's get any amount from SSI they are

automatically given medicaid.

I would apply for SSI. No one told me. I actually found out from a

teacher. I had no idea. I actually have 2 friends that could never

get SSD, both have mood disorders. One is bipolar and the other has

anxiety issues. Neither one could get SSd becuase they were never

able to hold a job long enough to earn the credits. They are both on

SSI. Your sons maybe entitled to " back Pay " once it is determined

that they are eligible they somehow magically determine when they

were first became disabled and they will recieve their pay from that

date. For instance, I was unaware that my son could recieve SSI until

about a year after dx...he was awarded the SSI and recieved a check

for all the past months he was disabled. Since they are " adults " your

income may not apply. Which is great!

I DO NOT KNOW ALL THE CACLULATIONS OR HOW THEY DETERMINE ALL OF

THIS.. it's gov red tape and garggle talk to me. lol

I believe you have a certain amount of time to appeal the decision as

well. You may want to pursue that, even if you " mistakenly " applied

for the wrong category (SSD vs. SSI). I would point out what you

told the intake person about them having AS and never have worked,

and I agree, that person should have told you the difference between

SSD and SSI. They were probably not wrong in denying the SSD, but if

you file an appeal they will look at the application date or the

original date of disablement. If you just file a new case I think

that starts the clock ticking all over again.

Also, it stinks that their benefits are reduced or eliminated if you

work. It's not like the kids' special needs go away just because you

work... if anything you have additional needs if you have to consider

sitters, etc. so you CAN work!

Enough of my rant... good old federal government in action!

I live in VA and Autism is an accepted disability with Medicaid, SSI and DMV

(for handicap placard).

I will tell you though that for Medicaid, Medicaid Waiver and SSI you usually

have to apply 2 times cause the first time it is automatically disapproved. Not

sure why.

What part of VA are you in? I grew up in Va Beach (brother and sister

are still there), and we are in central NC now. I think the Medicaid

denial thing is their way of discouraging folks from using it!

Yes, I beleive she would qualify. My son was orginally Dx's with

Develpmental Delay w/ Speech and Language imparied. He got it right

away. We are also in Florida. Check on www.ssa.gov for the listing

of impairments for children you can see exactly what they look for

when determining disability. These programs are designed to help us.

Use them. My son was given medicaid becuase he is a child on SSI. I

did not have to apply for anything. I can not get help for myself.

However, he can.
