You have a right to call an IEP meeting ANY time you want. You can

have an IEP meeting every month of the year if you feel that your

child needs something added to it.

When I wanted to add something to my son's IEP I just called the

person and said we need to have an IEP meeting and she gets everyone

together within a week or 2 when everyone can make it.

Im not sure what the laws are regarding this..But for us..its within a

week..after i request it .That i have what i want..sometimes within

days..if its emergent..depending. I have emailed my sons special ed

teacher to ask what the law states..shes usually really good at

getting back to me..Unless you find out in a more efficient manner..i

will email tomorrow when she gets back to me

Yes, but are they allowed to take three months to get all of them

together in one spot for a meeting? What's the timeline?

If your child is receiving special education services, his or her IEP will

be reviewed in an IEP meeting at least once a year to determine how well it is

meeting his or her needs. In addition, every three years, your child will be

reassessed and his or her IEP reviewed as part of an overall comprehensive

reevaluation of your child's progress.

If there are concerns that your child's educational needs are not being met,

either you or school personnel may request a reassessment or an IEPO meeting

to review the IEP at any time during the year. You may request an IEP meeting

to review the IEP at anytime during the year. You may request an IEP meeting

by sending a written request to the school. Once your request is received,

the meeting must be held within thirty (30) days, not counting school

vacations greater than five (5). You may request a reassessment by sending a

written

request to the school or completing a Request for Special Education

Assessment which can be obtained at any District school. The school must get

your

permission before it reassesses your child

Legally an IEP review meeting has to take place within 30 days of requesting

it. Liz, in your case, seeing that it is an emergency, perhaps the school

district will schedule it ASAP...I would hope anyway. Pam :)

You are lucky to be able to get one that quick. It took me three years to

convince the rep in our area that needs an IEP. spent so much

time in the hospital, 8 times in one school year, we tried having a tutor come

to the house, and at one time homeschooling. Finally this year when he kept

having breakdowns in school and his case manager called her did I get a proper

IEP meeting. Then it was easier pulling teeth, but finally got him into a

school for children with emotional disturbances. Since, has been doing

well and getting better grades. For the most part he goes to school now also,

before he wouldn't get up or I had to pick him up from school because he would

get really sick from the stress. I finally had teachers that actually cared and

would get concerned when would shut down. Even his case manager didn't

like her. She acts like she is better than everyone else and that parents are

the ones with the problems with thier kids.

I know there are laws and just getting her to get a meeting is a miracle.

Good luck to you and don't give up. Be like me and be a pain in the butt

until you get a meeting.

I'm a bit behind reading the daily digests, so I don't know if anyone responded

to this, but

since you're in California, I'll quote from the CDE Composite of Special Ed

Laws, Ed Code

56343.5 states " A meeting of an individualized education program team requested

by a

parent to review an individualized education program pursuant to subdivision ©

of

section 56343 shall be held within 30 days, not counting days in July and

August, from the

date of receipt of the parent's written request. If a parent makes an oral

request, the

school district shall notify the parent of the need for a written request and

the procedure

for filing a written request "

Any parent of a child in California with an IEP in entitled to receive a copy of

the Special

Education A Composite of Laws--a 10 lb tome with all the special ed laws in it.

It can be

really helpful (intimidating) to show up for potentially contentious meetings

with your copy

in evidence (preferably with post it notes sticking out).

To get your free copy (and you'll automatically get a new one free each year so

you

always have an up to date copy), go to:

You should call your local school sped department and ask them directly what

the policy is. Usually I find that official rules will state " In a timely

manner " and leave that up to everyone to decide. I would think it would

take about one week, possibly two, to have an IEP meeting. Two only if

there are a lot of people to juggle, less if there are only a few people

coming. And if it is an emergency, I would guess a few days is enough to

gather most of the troops together.

If not, I would make an appt with the head of the sped dept and take my

concerns there.
